Welcome to The Sleep Shapers.

These Terms & Conditions apply to your use of The Sleep Shapers website and to any consultations, sleep support packages, personalised sleep plans, digital guides, resources or other services purchased from or provided by us.

By accessing our website, purchasing a product or service, booking a consultation or engaging The Sleep Shapers, you agree to these Terms & Conditions.

Throughout these Terms, “The Sleep Shapers”, “we”, “us” and “our” refer to The Sleep Shapers. “You”, “client” and “family” refer to the person purchasing or receiving our services.

1. Our Services

The Sleep Shapers provides baby and child sleep education, guidance and support to parents and caregivers.

Depending on the package or product purchased, our services may include:

  • Video or telephone consultations

  • Review of sleep and feeding information provided by you

  • Personalised sleep recommendations or sleep plans

  • Follow-up support via the communication methods specified in your package

  • General sleep education

  • Digital guides, eBooks, PDFs and other downloadable resources

The inclusions, duration and level of support provided will be those described on our website or in your booking confirmation at the time of purchase.

2. Sleep Consulting Is Not Medical Advice

The information and support provided by The Sleep Shapers is educational in nature and is not a substitute for medical advice, diagnosis or treatment.

While our professional backgrounds may include healthcare experience, our sleep consulting services are provided in our capacity as baby and child sleep consultants and should not be considered medical care.

You should seek advice from your GP, paediatrician, child and family health nurse or another appropriately qualified healthcare professional if you have concerns about your child's:

  • Health or development

  • Feeding or nutrition

  • Weight gain or growth

  • Breathing

  • Reflux or other medical symptoms

  • Sleep where an underlying medical condition may be contributing

You must inform us of any diagnosed or suspected medical conditions, feeding concerns, developmental considerations or other circumstances that may reasonably affect our recommendations.

Where appropriate, we may recommend that you obtain medical advice or clearance before implementing particular sleep changes.

3. Safe Sleep

Your child's safety must always take priority over any sleep recommendation.

Parents and caregivers remain responsible for ensuring their child's sleep environment and sleeping arrangements are appropriate and safe.

Our recommendations should be implemented alongside current safe sleep advice relevant to your child and circumstances.

If any recommendation provided by The Sleep Shapers conflicts with advice given to you by your child's treating healthcare professional, you should discuss this with the relevant healthcare professional before proceeding.

4. Individual Results

Every baby and child is different.

Sleep can be influenced by many factors including age, development, temperament, feeding, health, environment, parental preferences and consistency of implementation.

For this reason, The Sleep Shapers cannot guarantee:

  • That your child will sleep through the night

  • A particular number or duration of naps

  • Elimination of night waking

  • A specific improvement within a particular timeframe

  • That a particular settling technique will work for your child

We will provide recommendations based on the information available to us and work collaboratively with you within the scope of the service you have purchased.

5. Your Responsibilities

Our recommendations rely heavily on the information you provide.

You agree to provide information that is accurate and complete to the best of your knowledge, including relevant information regarding your child's sleep, feeding, health, development, routines and family circumstances.

You remain responsible for deciding whether and how to implement our recommendations.

You should contact us during your support period if you are unsure about any recommendation or if your child's circumstances materially change.

6. Consultations and Appointments

Consultations are provided at the date and time confirmed at booking.

Please ensure you are available and ready to commence at your scheduled appointment time.

If you arrive late, your consultation may still need to finish at the originally scheduled time so that subsequent appointments are not affected.

Where a client does not attend a scheduled consultation and has not provided notice, the consultation may be considered used and may not be eligible for a refund or replacement appointment.

7. Rescheduling

We understand that babies get sick and family life can be unpredictable.

One complimentary reschedule is available where at least 48 hours' notice is provided.

Where less than 48 hours' notice is provided due to illness or a genuine family emergency, we will generally offer one complimentary reschedule.

Additional rescheduling requests may incur an administration fee or require a new booking, depending on the circumstances and availability.

Rescheduled appointments are subject to consultant availability.

8. Cancellations and Refunds

Cancellations more than 48 hours before a consultation

If you cancel more than 48 hours before your scheduled consultation, you may choose either:

  • A full refund; or

  • One complimentary reschedule.

Illness or Family Emergency Within 48 Hours

If you need to cancel within 48 hours due to illness or a genuine family emergency, we will offer one complimentary reschedule.

Where appropriate, we may request reasonable supporting information before approving a refund or complimentary reschedule.

Change of Mind Within 48 Hours

Cancellations within 48 hours due to a change of mind are not eligible for a change-of-mind refund.

We may offer one reschedule at our discretion, subject to availability.

Once Services Have Commenced

Once a consultation has commenced or substantial work has commenced on a personalised sleep plan, a change-of-mind refund will generally not be available.

Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law.

9. Personalised Sleep Plans

Personalised sleep plans require preparation based on information provided by your family and are created specifically for your child.

Once preparation of your personalised sleep plan has substantially commenced or the sleep plan has been delivered, a change-of-mind refund is not available.

If information provided to us changes significantly after the plan has been prepared, additional consultation or plan changes may incur an additional fee.

10. Commencement of Your Support Period

Where your package includes an ongoing support period, your support period begins on the commencement date agreed with The Sleep Shapers.

The support period does not automatically pause if you decide to delay implementation of your sleep plan.

If you need to postpone your commencement date, please contact us as soon as possible.

Where possible, we will accommodate one change to your commencement date within 30 days of receiving your sleep plan.

If implementation is delayed beyond this period, your child's sleep needs, routine or development may have changed. In these circumstances, we may recommend or require an additional consultation or Sleep Reset before providing updated recommendations.

Any additional service will be discussed with you before a fee is charged.

11. Follow-Up Support

Where your package includes follow-up support, the duration and method of that support will be specified in the package purchased.

Support may include communication by email, messaging, telephone or another nominated platform.

Unless otherwise specified:

  • Support must be used within the allocated support period.

  • Unused support cannot be carried forward indefinitely.

  • Messages received outside our normal business hours may be responded to on the next business day.

  • Follow-up support relates to the child and sleep concerns covered by the original consultation.

Significant new sleep concerns, developmental changes or circumstances arising after the support period may require a new consultation.

12. Digital Products

Digital products may include eBooks, guides, PDFs, templates and other downloadable resources.

Because digital products are supplied electronically and access is generally provided immediately, we do not offer refunds for change of mind once the digital product has been supplied or made available for download.

If you experience difficulty accessing your purchase, please contact us so we can assist.

Nothing in this section excludes any rights or remedies available to you under the Australian Consumer Law.

13. Payments

Payment must be made in accordance with the price and payment terms displayed at the time of booking or purchase.

Unless otherwise stated, prices displayed on our Australian website are in Australian dollars.

Your appointment or service may not be confirmed until payment has been successfully received.

Where payment is processed by a third-party payment provider, such as Stripe, your payment information may also be subject to that provider's terms and privacy practices.

14. Promotions and Discount Codes

Discount codes and promotional offers are subject to any conditions stated at the time of the promotion.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash.

  • Only one discount or promotion may be used per transaction.

  • Discounts cannot generally be retrospectively applied to previous purchases.

  • Promotions may be amended or withdrawn at any time, subject to applicable law.

15. Consultant Cancellations

If we need to cancel or reschedule an appointment due to illness or unforeseen circumstances, we will contact you as soon as reasonably possible.

You will be offered either:

  • A complimentary rescheduled appointment at a mutually convenient time; or

  • A refund if we are unable to provide the service.

If a service has already commenced and we are unable to complete the remaining component, we will first attempt to arrange completion of the outstanding support.

Where this is not reasonably possible, an appropriate refund or other remedy will be provided for the affected portion of the service.

16. Communication

Please use the communication methods included in your package when contacting us for sleep support.

We aim to respond within the timeframe specified for your service; however, response times may occasionally vary due to weekends, public holidays, illness or other unforeseen circumstances.

Our messaging and email support is not an emergency or medical service.

If you are concerned about your child's immediate health or safety, seek appropriate medical assistance.

17. Intellectual Property

Unless otherwise stated, all content created or provided by The Sleep Shapers remains our intellectual property.

This includes, but is not limited to:

  • Personalised sleep plans

  • Guides and eBooks

  • Checklists

  • Templates

  • Website content

  • Educational materials

  • Graphics

  • Videos

  • Worksheets and resources

Resources purchased or provided to you are for your personal and household use only.

You must not, without our written permission:

  • Copy or substantially reproduce our resources

  • Upload or share paid materials publicly

  • Distribute resources to other families

  • Sell, license or commercially exploit our materials

  • Modify our resources and represent them as your own

  • Use our materials to provide sleep consulting or other commercial services

You are welcome to share general information about your experience with The Sleep Shapers, but purchased or personalised materials must not be distributed.

18. Confidentiality

Information you provide during your consultation will be treated respectfully and confidentially.

We may keep appropriate records relating to your consultation, sleep plan and communications for business, professional and administrative purposes.

We will not intentionally publish personally identifiable details about your family without your consent, except where disclosure is required or permitted by law.

Our collection and handling of personal information is also governed by our Privacy Policy.

19. Testimonials and Client Stories

We will not publish identifiable photographs, testimonials, messages or detailed client stories for marketing purposes without appropriate permission.

If permission is given, you may contact us if you later wish to discuss future use of that material.

20. Website Information

Information provided on our website, social media channels, blogs and free resources is general educational information only.

It does not take into account your child's individual circumstances and should not be treated as personalised sleep advice.

We aim to keep our information accurate and current, but recommendations and best-practice guidance can change over time.

21. Third-Party Services and Links

Our website may contain links to third-party websites, services or products.

We are not responsible for the content, availability, security or privacy practices of third-party websites or services.

Any third-party product mentioned by us should be considered in the context of your own child's needs and applicable safety guidance.

22. Limitation of Liability

To the extent permitted by law, The Sleep Shapers is not responsible for loss or damage arising solely from circumstances outside our reasonable control or from recommendations being implemented in a way that differs materially from the guidance provided.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

23. Australian Consumer Law

Our services and products come with rights that may apply under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify a guarantee, right or remedy that cannot legally be excluded, restricted or modified.

Where a provision of these Terms is inconsistent with a mandatory right under applicable law, that mandatory right will apply.

24. Exceptional Circumstances

We understand that every family's circumstances are different.

We may make reasonable exceptions to our cancellation, rescheduling or support policies in genuine exceptional circumstances at our discretion.

Any exception made on one occasion does not require us to make the same exception in the future.

25. Changes to These Terms

We may update these Terms & Conditions from time to time.

The Terms that apply to your purchase will generally be those available at the time you make your booking or purchase, unless a change is required by law or agreed between us.

The latest version will be available on our website.

26. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.
